A federal judge has granted summary judgment in a case involving the sale of Viagra and other drugs illegally in the United States. A drug plaintiff may be allowed to file a negligence action against a pharmaceutical manufacturer for injuries caused by improper sale or use of Viagra. The plaintiffs in this case claim that the defendants violated FDA regulations when they sold and promoted Viagra to consumers. The FDA's decision in favor of plaintiff A. M. R. and the manufacturer of Viagra is not surprising given the drug's use for erectile dysfunction in the United States. The FDA approved Viagra in 1996, and its approval was later extended to 1998.

The FDA concluded that the defendants failed to meet their statutory burden of proof to show that the drugs were used by consumers who suffered adverse side effects when used in association with sildenafil, tadalafil, or vardenafil. The FDA also found that the drugs were not "otherwise approved" in the United States, but rather only for the purpose of "preventing the spread of drug-resistant bacteria" and "to promote the development of new drugs with improved efficacy and safety profile." The FDA found that the drugs were used for "the relief of erectile dysfunction," and the defendants had "improperly marketed" the drugs. The FDA found that the defendants "failed to establish that their conduct was in bad faith." The FDA found that "the drugs are not drug-free and are not being used for a purpose other than their approved use."
The district court granted summary judgment for the defendants, finding that the plaintiffs were entitled to summary judgment on the claims. The district court also granted summary judgment for CVS for the drugs. The district court found that the drugs were not "otherwise approved" and "were not used for a purpose other than the approved use," and that the defendants "had misbranded." The district court rejected the defendants' arguments that the drugs were "otherwise approved," and also rejected the defendants' argument that the drugs were "non-brand and non-approved." First, we must determine if there are genuine issues of material fact. The plaintiffs contend that the defendants were aware of the drug's potential side effects and that the FDA's review of the literature, which included information on the safety of sildenafil and tadalafil, found "serious" side effects in some men with erectile dysfunction. They also assert that they were not aware that these drugs were used for the relief of erectile dysfunction, and that they had no knowledge of the side effects when the drugs were distributed in the United States. The defendants point out that the FDA's review of the literature found that the drugs were "not approved" and "were not used for the relief of erectile dysfunction." In addition, they contend that the FDA had only limited information about the side effects of sildenafil, tadalafil, and vardenafil, and not the side effects of the drugs.
The district court found that the drugs were "otherwise approved," but that the drugs were "not being used for a purpose other than their approved use." The district court also found that the drugs were "misbranded," but that the defendants had "misbranded." The district court found that the drugs were not "otherwise approved," and that "the Defendants knew of the serious side effects and failed to properly market the drugs to consumers."
We have already determined that the plaintiffs are entitled to summary judgment on their negligence claims, and we affirm the district court's decision to grant summary judgment. The defendants are required to "not only establish that the drugs were unreasonably dangerous, but also establish that the plaintiffs' injuries are likely to be permanent." (Rates of damages under state law are measured by the amount of damages recovered, not by the amount recovered.
